GPT-4 Passes the Bar Exam: AI-powered technology such as LLMs can help to close the access to justice gap

CodeX–The Stanford Center for Legal Informatics and legal tech company Casetext announced that they have reached a groundbreaking moment in their research in the AI field. Collaborators deployed GPT-4, the most advanced generation of Large Language Models (LLM), to take the Uniform Bar Exam (UBE), and not only did it pass the multiple-choice portion, but also both components of the written part, scoring in the 90th percentile – exceeding all prior LLMs’ scores and also the average score of real-life bar exam takers. In an interview with Pablo Arredondo, JD ’05, who is Casetext’s Chief Innovation Officer and co-founder, he discussed how this breakthrough in AI can lead to the evolution of LLM-powered professional-grade AI products and what it means for the legal profession.

The technological strides that GPT-4 has made from GPT-3 to improve its ability to interpret text and perform complex or domain-specific tasks like those in the law are driven by the scale of the underlying models more than any fine-tuning for law. GPT-4 has outperformed smaller models that have been fine-tuned for law, and the more this technology is used in the legal profession or the more it takes the bar exam, the better it becomes and more useful it is to the legal profession. The rate of progress in the AI field is remarkable, and one of the most exciting areas that are being developed is Agentic AI, where LLMs have the ability to “themselves” strategize about how to carry out a task.

AI-powered technology can definitely help to close the access to justice gap, and this might be the most important thing LLMs do in the field of law. Through LLMs, attorneys can be much more efficient and help to increase access to justice by empowering them to serve more clients. Despite the power of this technology, attorney oversight is still required, and AI should be viewed as a very powerful tool that enables lawyers to better represent their clients.

While the development of this technology has raised concerns about control and access and the ways it will affect training the next generation of attorneys, AI’s double-edged sword can still be a powerful ally for attorneys and their clients. As long as we focus on how to use the current technology responsibly and work together to understand its implications, we can ensure that it serves us best.
