FTC launches probe into leading AI startups’ partnerships with Big Tech companies

U.S. Antitrust Enforcers Investigating AI Startup Ties to Tech Giants

The U.S. Federal Trade Commission (FTC) is launching an investigation into the connections between major artificial intelligence startups and tech giants like Amazon, Google, and Microsoft. The focus is on the potential influence and privileged access these relationships may give to dominant firms, possibly undermining fair competition in the generative AI sector.

The inquiry will review the investments and partnerships between AI developers and major cloud service providers. Compulsory orders have been issued to Amazon, Google, Microsoft, as well as AI startups Anthropic and OpenAI, requiring them to provide information regarding their investments and partnerships.

The goal is to analyze whether deals such as Microsoft’s long-standing relationship with OpenAI, and the recent multibillion-dollar deals made by Google and Amazon with Anthropic, should be considered as quasi-mergers.

Europe has also signaled their intention to scrutinize the relationship between Microsoft and OpenAI, with the European Union and the United Kingdom considering investigations into potential competition concerns.

Antitrust advocates have welcomed these actions, emphasizing the need for regulators to intervene in the ways Big Tech firms exert influence on top A.I. companies, without formally acquiring them.

The article details Microsoft’s significant but undisclosed investment in OpenAI, the controversial governance issues within OpenAI, and the exclusive rights Microsoft gains from their partnership with the AI startup.

The FTC has made it clear that they will not hesitate to stop harmful business practices involving AI and will be closely monitoring illegal behavior in the use and development of AI tools.

Companies involved have 45 days to provide detailed information about their partnership agreements and the strategic rationale behind them, as well as decision-making processes around product releases and the resources needed to build AI systems.
